Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Spotlr Fitness web platform and member mobile app (together, the "Services") provided by Spotlr Fitness ("we", "us", "our"). By creating an account or using the Services, you agree to these Terms. If you use the Services on behalf of a gym or other organization, you represent that you have authority to bind that organization.
Accounts
- You must provide accurate information when creating an account and keep it up to date.
- You are responsible for safeguarding your credentials and for all activity under your account.
- Gym owners and administrators are responsible for the access they grant to staff and trainers.
- Notify us promptly at hello@zeltenlabs.com if you suspect unauthorized use.
Use of the Services
- Use the Services only for lawful purposes and in accordance with these Terms.
- Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the Services.
- Do not upload content that is unlawful, infringing, or harmful to others.
- We may suspend or terminate accounts that violate these Terms or put the Services at risk.
Subscriptions & billing
- Paid plans are billed in advance on a monthly or annual basis and renew automatically until cancelled.
- You can cancel at any time; access continues until the end of the current billing period.
- Fees are non-refundable except where required by law.
- We may change pricing with reasonable advance notice; changes apply from your next billing cycle.
Your data
You retain ownership of the data you and your members enter into the Services. You grant us the rights needed to host, process, and display that data in order to operate the Services. You can export your data at any time. Our handling of personal data is described in our Privacy Policy.
Member relationships
Gyms are responsible for their relationships with their members, including membership agreements, pricing, refunds, and compliance with local laws. Spotlr Fitness provides the software; we are not a party to agreements between a gym and its members.
Third-party services
The Services integrate with third parties such as payment processors, messaging providers, and biometric hardware. Your use of those services may be subject to their own terms, and we are not responsible for third-party services we do not control.
Intellectual property
The Services, including software, design, and branding, are owned by Spotlr Fitness and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
Disclaimers
The Services are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted or error-free. Fitness and nutrition content in the Services is informational and is not medical advice.
Limitation of liability
To the maximum extent permitted by law, Spotlr Fitness will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Services is limited to the amounts you paid us in the twelve months before the claim arose.
Termination
You may stop using the Services at any time. We may suspend or terminate the Services for breach of these Terms. Upon termination you may request an export of your data for a reasonable period, after which we may delete it in accordance with our retention practices.
Changes to these Terms
We may update these Terms from time to time. We will update the "Effective" date and, for material changes, provide additional notice. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
